APPLYING FOR A NON-IMMIGRANT VISA

Visa Eligibility

Please be aware that visa issuance is not automatic. United States immigration law places on each nonimmigrant visa applicant a presumption of immigrant intent, with the burden of proof on the applicant to overcome this presumption in order to establish his or her eligibility for a nonimmigrant visa. Applicants may overcome this presumption through the presentation of evidence of strong family, social and economic ties to their country of residence, which would compel them to depart the U.S. at the completion of their authorized stay.

A consular officer's determination of whether an applicant is entitled to nonimmigrant visa status is made on the basis of the objective circumstances presented by the applicant, and what these circumstances indicate about the applicant's intentions, as outlined above. The decision cannot be based on the assurances of friends, relatives or other associates of the applicant.
